The attorneys sued the league last month after Hernandez was diagnosed with chronic traumatic encephalopathy. They accused the NFL of hiding the true dangers of football. They sought damages on behalf of Hernandez’s 4-year-old daughter for the loss of her father’s companionship.

The federal case was dismissed on Friday. Attorney George Leontire told The Associated Press it will be refiled on Monday in Suffolk County Superior Court.

Hernandez killed himself this spring in the prison cell where he was serving a life sentence for murder. An examination of his brain showed that he had severe CTE, which has been shown to cause depression, violent mood swings and other cognitive problems in football players and others who have been subjected to repetitive head trauma.

Judge Jeffrey Locke ruled Wednesday that prosecutors can tell the jury about what they found on the phone when the former New England Patriots tight end goes on trial next month in the 2012 fatal shootings of two men he encountered at a Boston nightclub.

Hernandez’s lawyers argued that authorities learned about the phone through confidential communications between Hernandez and his sports agent, who also is an attorney. Prosecutors said Hernandez and the agent hadn’t established a protected attorney-client relationship.

Hernandez has pleaded not guilty in the killings.

He already is serving a life sentence in the 2013 killing of semi-professional football player Odin Lloyd.

Judge Jeffrey Locke on Tuesday denied a defense request to exclude his tattoos as evidence.

Prosecutors say Hernandez got two tattoos added in 2013. One shows a six-shot revolver with five bullets in the cylinder and one empty chamber. The other shows a semi-automatic pistol and a wisp of smoke coming from a spent shell casing.

Hernandez has pleaded not guilty in the 2012 killings of two men he encountered in a Boston nightclub. His trial is scheduled to begin next month.

He is already serving a life sentence in the 2013 killing of a semi-professional football player.

Superior Court Judge Richard Moses on Thursday authorized the sale of the former tight end’s 7,100-square-foot home in North Attleborough and the SUV. The judge is to enter an order later specifying what happens to the sale proceeds.

Hernandez was convicted and sentenced to life in prison in April for the 2013 murder of Odin Lloyd, who was dating the sister of Hernandez’s fiancee. Lloyd’s mother, Ursula Ward, filed the wrongful death lawsuit against Hernandez.

Hernandez also is awaiting trial for the killings of two men in Boston.

Hernandez lawyer James Sultan filed papers under seal requesting an inquiry into a juror’s ”exposure to significant extraneous matter.” Sultan hasn’t disclosed details about the issue, and prosecutors have said they don’t know, either.

GateHouse Media attorney Zack Kleinsasser says Hernandez’s attorneys haven’t shown why the documents need to be sealed and haven’t provided alternatives, such as redaction.

Garsh took the arguments under advisement.

Hernandez was convicted of killing Odin Lloyd in 2013. He was sentenced to life in prison.
