(AP) A state judge has ordered Jerry Sandusky be taken to a central Pennsylvania courtroom next month for resentencing on his 45-count child sexual abuse conviction, six months after an appeals court ruled mandatory minimums had been improperly applied.</p>
<p>Judge John Foradora filed an order Wednesday that scheduled the proceeding for Sept. 23.</p>
<p>Sandusky, a former Penn State assistant football coach, was convicted in 2012 of the sexual abuse of 10 boys, including attacks on campus. Victims testified he subjected them to abuse that ranged from grooming to violent sexual attacks. He was sentenced to 30 to 60 years, but that term was overturned by Superior Court in February.</p>
<p>His defense lawyer has said it was not clear whether a substantially different sentence will result.</p>
<p>The state Supreme Court last month declined to grant Sandusky, 75, a chance to argue he deserves a new trial, and Sandusky defense attorney Al Lindsay said at that time that he will likely seek relief in the federal courts.</p>
<p>Foradora directed Sandusky to be transported to appear at the hearing.</p>
<p>Lindsay&#8217;s office said Thursday he was not available for comment, and the attorney general&#8217;s office declined comment.</p>
<p>Sandusky&#8217;s November 2011 arrest shook Penn State, prompting the firing of Hall of Fame head coach Joe Paterno and the ousting of then-university President Graham Spanier. The university subsequently paid more than $100 million to people who said they had been abused by Sandusky.</p>
<p>Spanier and two other senior administrators, Tim Curley and Gary Schultz, were charged over their response to reports about Sandusky. Curley and Schultz pleaded guilty to child endangerment in 2017 for failing to notify authorities in 2001 of a complaint about Sandusky and a boy in a team shower.</p>
<p>Spanier went to trial and was convicted of misdemeanor child endangerment, but a federal judge in April threw it out, ruling he had been improperly charged under a 2007 law for actions that occurred in 2001.</p>
<p>The attorney general&#8217;s office is appealing that decision to the 3rd U.S. Circuit Court of Appeals.</p>

(AP) Jurors in the criminal trial of former Penn State University president Graham Spanier spent more than six hours deliberating Thursday without reaching a verdict regarding the child endangerment and conspiracy charges he faces in the Jerry Sandusky sex abuse scandal.The panel got the case after Spanier&#8217;s attorneys declined to call any witnesses to counter accusations he acted illegally in handling a 2001 complaint about Sandusky, a former assistant football coach, showering with a boy. Deliberations were scheduled to resume Friday.</p>
<p>In a closing argument, Spanier attorney Sam Silver said there was &#8221;no evidence&#8221; and the case involved judgment calls by high-ranking university administrators in dealing with the complaint Sandusky had been seen naked with the boy in a team locker room.</p>
<p>&#8221;They made judgment calls,&#8221; Silver said. &#8221;They did not engage in crimes. They did not enter in a conspiracy.&#8221;</p>
<p>Prosecutor Laura Ditka said Spanier, former athletic director Tim Curley and former vice president Gary Schultz took actions to preserve the university and their own reputations, at the expense of children.</p>
<p>&#8221;They took a gamble,&#8221; Ditka told jurors. &#8221;They weren&#8217;t playing with dice. They were playing with kids.&#8221;</p>
<p>Spanier, who didn&#8217;t testify, faces three felonies. Curley and Schultz struck plea deals last week to a misdemeanor count of child endangerment and testified against Spanier.</p>
<p>Spanier was forced out as president in 2011, after Sandusky was charged with child molestation and Curley and Schultz were charged over their handling of the matter. Spanier was charged a year later.</p>
<p>Sandusky has been in prison since his 2012 conviction on dozens of counts of child sexual abuse and was expected to be in a courthouse near campus Friday for an appeal hearing. He insists he&#8217;s innocent.</p>
<p>During deliberations, the Spanier jury twice returned to the courtroom, asking the judge about what makes someone a supervisor of a child under the law, what constitutes a criminal conspiracy and how the law defines reckless.</p>
<p>The abuse scandal sent shockwaves through the Penn State community, led to the firing of Hall of Fame coach Joe Paterno, who died of cancer in early 2012, and ultimately led the university to pay more than $90 million to settle civil claims.</p>
<p>Silver called Spanier, Curley and Schultz &#8221;good men&#8221; who took seriously the 2001 complaint by then-graduate assistant coach Mike McQueary.</p>
<p>He urged jurors to focus on testimony by Schultz and Curley that they never told Spanier that McQueary had reported seeing something sexual, although McQueary&#8217;s testimony was that he did tell the two of them it was sexual in nature.</p>
<p>&#8221;Mr. Schultz made clear &#8211; he, Gary Schultz, told Graham Spanier that it was horseplay,&#8221; Silver said.</p>
<p>A key piece of evidence was an email exchange in which the three debated what to do.</p>
<p>Spanier OK&#8217;d having Curley tell Sandusky to stop taking children to athletic facilities and inform The Second Mile, a charity for at-risk youth founded by Sandusky. An earlier plan had involved informing the state Department of Public Welfare, but Spanier approved putting that on hold, and the agency was never contacted. That failure to make a report forms the heart of the criminal accusations against him.</p>
<p>&#8221;The only downside for us is if the message isn&#8217;t `heard&#8217; and acted upon, and we then become vulnerable for not having reported it,&#8221; Spanier told Curley and Schultz in the 2001 email exchange.</p>
<p>Silver said several people knew of McQueary&#8217;s complaint and The Second Mile&#8217;s director was informed.</p>
<p>Ditka began her closing argument with reference to the &#8221;only downside for us&#8221; quote and repeated it several times, urging jurors to convict.</p>
<p>&#8221;All they cared about was their own self-interest,&#8221; Ditka said, arguing the three men &#8221;let (Sandusky) run wild&#8221; despite knowing he had been the subject of complaints in 1998 and 2001.</p>
<p>The 1998 complaint, from a woman upset that Sandusky had bear-hugged her son in a team shower, was investigated, but the district attorney declined to file charges.</p>
<p>Ditka said McQueary told Curley and Schultz he saw Sandusky behind a prepubescent boy, in a dark shower at night, with his hips moving slightly.</p>
<p>&#8221;Do you think that&#8217;s horseplay?&#8221; she asked jurors.</p>
<p>She dismissed any idea three of the university&#8217;s top leaders would have immediately launched a series of meetings and discussions if they really thought it was just horseplay.</p>

<p>The Superior Court sessions Tuesday in Harrisburg will focus on the actions of Penn State&#8217;s then-general counsel, Cynthia Baldwin. She was involved as the men were being investigated for an alleged cover-up of child sex abuse complaints against Jerry Sandusky.</p>
<p>The judges are expected to conduct three separate half-hour sessions. There will be one each for former university president Graham Spanier, former vice president Gary Schultz and former athletic director Tim Curley.</p>
<p>At issue is a January order by Dauphin County Judge Todd Hoover that rejected arguments by the three about the fairness and legality of the process that resulted in charges.</p>

										<content:encoded><![CDATA[<p>No. 1-rated quarterback prospect and Penn State recruit Christian Hackenberg said Sunday he&#8217;s confident that coach Bill O&#8217;Brien would not leave the school for opportunities in the NFL.</p>
<p>&#8220;I mean, I&#8217;m hoping,&#8221; Hackenberg said as he prepared to begin workouts on Monday for the Under Armour All-America Game at Disney&#8217;s ESPN Wide World of Sports. &#8220;I&#8217;ve got my fingers crossed.&#8221;</p>
<p>ESPN&#8217;s Chris Mortensen reported Sunday that O&#8217;Brien may be on more short lists for NFL teams &#8212; including the Cleveland Browns and Philadephia Eagles &#8212; than Oregon coach Chip Kelly, according to league sources.</p>
<p>The 6-foot-4, 212-pound Hackenberg said he spoke with O&#8217;Brien about NFL jobs &#8220;a month or two ago.&#8221;</p>
<p>&#8220;He&#8217;s not worried about it,&#8221; Hackenberg, who is also the No. 16 player in the nation, said. &#8220;He&#8217;s worried about coaching Penn State.&#8221;</p>
<p>Hackenberg showed his loyalty to PSU by sticking to his commitment, made in February, through the July revelation of NCAA sanctions in the wake of the Jerry Sandusky scandal. Penn State was banned from the postseason for four years and docked 40 scholarships over the same period.</p>
<p>The quarterback cited his relationship with O&#8217;Brien and Penn State quarterbacks coach Charlie Fisher as a primary factor in his decision to stay with the Nittany Lions.</p>
<p>&#8220;My parents felt comfortable handing me over to them for four years,&#8221; Hackenberg said. &#8220;I really felt a connection with those guys and felt a comfort level with them that I had nowhere else.&#8221;</p>
<p>If O&#8217;Brien left before signing day on Feb. 6, Hackenberg said he would reconsider his options.</p>
<p>&#8220;I&#8217;d think about it,&#8221; Hackenberg said. &#8220;He was a big part of it. He&#8217;s the guy who&#8217;s going to develop me. That&#8217;s one of the big things I looked at. I&#8217;ll see what happens.&#8221;</p>
